Welcome to SafeguardMDM. These Terms of Service ("Terms") govern your access to and use of the SafeguardMDM platform, including the web dashboard, mobile applications, and all related services (collectively, the "Service"). By creating an account or using the Service, you agree to be bound by these Terms.
1. Service Description
SafeguardMDM is a mobile device management platform designed for families and caregivers. The Service enables authorized parents, guardians, and caregivers to:
- Monitor and manage mobile devices belonging to children or elderly dependents under their legal care
- Track device location, application usage, screen time, and browsing activity
- Set content filters, app restrictions, scheduling rules, and homework/focus modes
- Receive alerts about concerning activity, low battery, and geofence events
- Capture photos or audio recordings from monitored devices when enabled
2. Eligibility and Account Registration
You must be at least 18 years of age and have legal authority over the devices and individuals you intend to monitor. By registering, you represent and warrant that:
- You are the legal parent, guardian, or authorized caregiver of any minor whose device is enrolled
- You have legal authority or written consent to monitor any adult device enrolled in the Service
- All information you provide during registration is accurate and current
- You will maintain the security of your account credentials
3. User Responsibilities
You agree to use the Service only for lawful family safety and caregiving purposes. You shall not:
- Install monitoring software on any device without the legal right to do so
- Use the Service to stalk, harass, intimidate, or exert coercive control over any individual
- Use the Service to monitor employees, partners, or any person who is not your legal dependent
- Attempt to circumvent safety features, abuse reporting systems, or rate limits
- Reverse engineer, decompile, or create derivative works from the Service
- Share, sell, or transfer your account to any third party
4. Monitoring Consent Requirements
SafeguardMDM requires that monitored individuals (or their legal guardians) are informed that monitoring is active. The Service displays persistent notifications on monitored devices and provides an abuse reporting mechanism accessible to all monitored users.
5. Data Collection and Use
To provide the Service, we collect and process certain data from enrolled devices, including but not limited to:
- Device location data (GPS coordinates, updated periodically)
- Application usage statistics and screen time metrics
- Browsing history and content filter logs
- Keyboard input for keyword flagging (opt-in, Tier 3 verification required)
- SMS messages and call logs for safety monitoring (opt-in)
- Contact list data for contact safety scoring
- Gallery and photo metadata with AI content classification (opt-in)
- Social media activity patterns and flagged content (opt-in)
- Photos captured through the remote camera feature (retained for 72 hours)
- Audio recordings when ambient listening is enabled (retained for 72 hours)
- Device metadata (battery level, network status, OS version)

6. Subscription and Billing
SafeguardMDM offers tiered subscription plans. By subscribing, you agree that:
- Subscription fees are billed in advance on a monthly or annual basis
- Your subscription will automatically renew unless canceled before the renewal date
- Refunds are available within 14 days of initial purchase if no monitored devices have been enrolled
- We reserve the right to adjust pricing with 30 days' written notice
- Free tier limitations apply as described on our pricing page
7. Account Suspension and Termination
We may suspend or terminate your account immediately, without prior notice, if:
- An abuse report is filed against your account and verified by our review team
- You violate these Terms or use the Service for unlawful purposes
- You fail to pay subscription fees after a reasonable grace period
- A court order or law enforcement request mandates account suspension
You may terminate your account at any time through the dashboard settings. Upon termination, all monitoring data will be deleted within 30 days in accordance with our data retention policy.
8. Limitation of Liability & Disclaimer
To the maximum extent permitted by applicable law:
- The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory
- We do not guarantee uninterrupted, error-free, or secure operation of the Service
- We are not liable for any actions taken by monitored individuals or for any harm arising from the use of monitoring data
- Our total liability for any claims arising from the Service shall not exceed the amount you paid in subscription fees during the twelve months preceding the claim
- In no event shall we be liable for indirect, incidental, special, consequential, or punitive damages
9. Indemnification
You agree to indemnify and hold harmless SafeguardMDM, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.
10. Changes to Terms
We may update these Terms from time to time. Material changes will be communicated via email to the address associated with your account at least 14 days before taking effect. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
